1. Eligibility and Acceptance
You must use ShowingScan only in compliance with applicable law and these Terms. If you use ShowingScan on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.
2. Description of the Service
ShowingScan helps users document property conditions during tours, organize observations by room and issue type, capture media, and export summaries or reports. Features may change over time, and some features may be optional, limited, build-specific, or available only when certain device permissions or platform services are enabled.
3. Accounts and Access
- You may be able to use portions of ShowingScan without signing in.
- If you create or use an account, you are responsible for maintaining the confidentiality of your credentials and for activity under your account.
- You agree to provide accurate information and to update it when necessary.
- We may suspend or terminate access if we reasonably believe your use violates these Terms, creates risk, or is unlawful.
4. Your Content
You retain ownership of the content you create or submit through ShowingScan, including notes, checklist responses, issue records, photos, and videos. You grant Lumo LLC a limited, non-exclusive license to host, store, process, transmit, and display that content solely as needed to operate, secure, support, and improve ShowingScan.
You are solely responsible for your content, including its accuracy, legality, and whether you have the right to capture, upload, store, export, or share it.
5. Recording, Property Access, and Permissions
You agree that you will:
- Capture media only where you have permission or a lawful right to do so.
- Comply with applicable privacy, recording, consent, landlord-tenant, listing, and property-access laws.
- Respect tour rules, lease terms, brokerage instructions, and on-site restrictions.
- Obtain any permissions or consents needed before photographing or filming other people, their belongings, or private areas.
6. Acceptable Use
You may not:
- Use ShowingScan for unlawful, fraudulent, deceptive, infringing, abusive, harassing, or privacy-violating activity.
- Attempt to probe, scan, reverse engineer, disable, or interfere with the service or its security.
- Use the service to build a competing product by scraping, copying, or extracting protected data or content at scale.
- Misrepresent a report, checklist, or user-generated summary as a professional inspection, certification, appraisal, or legal finding.
7. Important Product Limitations
- ShowingScan does not guarantee that a property is safe, habitable, code-compliant, defect-free, or suitable for purchase or tenancy.
- Checklist content, summaries, tags, and exports are informational tools only and may be incomplete.
- You should not rely on ShowingScan as a substitute for professional inspections, contractor evaluation, legal advice, appraisal, disclosure review, or due diligence.
8. Third-Party Services and Platforms
ShowingScan may integrate with or depend on third-party platforms and services, including Apple platform services, identity providers, cloud infrastructure, analytics, and diagnostics providers. Your use of third-party services may also be subject to those providers' separate terms and privacy policies.
If you obtain the app through Apple's App Store, Apple's applicable platform terms may also apply. Apple is not responsible for ShowingScan's maintenance or support except as required by law.
9. Beta Features and Service Changes
ShowingScan may offer beta, preview, or pre-release features. Those features may be modified, suspended, or removed at any time. We may also update, change, or discontinue any part of the service at any time, with or without notice, to the extent permitted by law.
10. Disclaimers
To the maximum extent permitted by law, ShowingScan is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory. We do not warrant uninterrupted service, error-free operation, or that any data, report, or export will always be accurate, complete, or preserved without loss.
11. Limitation of Liability
To the maximum extent permitted by law, Lumo LLC and its affiliates, officers, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, use, or data, arising out of or related to your use of ShowingScan.
To the maximum extent permitted by law, the total aggregate liability of Lumo LLC for all claims arising out of or relating to ShowingScan will not exceed the greater of $100 USD or the amount you paid to Lumo LLC for ShowingScan in the 12 months before the event giving rise to the claim.
12. Indemnity
You agree to indemnify and hold harmless Lumo LLC and its affiliates, officers, employees, contractors, licensors, and service providers from and against claims, liabilities, damages, losses, and expenses arising out of or related to your content, your misuse of ShowingScan, or your violation of these Terms or applicable law.
13. Termination
You may stop using ShowingScan at any time. We may suspend or terminate your access if we reasonably believe you have violated these Terms, created legal or security risk, or misused the service. Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, and indemnity.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date above and may provide additional notice when appropriate. Your continued use of ShowingScan after the updated Terms take effect means you accept the revised Terms.
